فقه الموازنات وأثره في المستجدات

Abstract

تمحورت دراستنا حول موضوع «فقه الموازنات وأثره في المستجدات الطبية»، حيث سعينا من خلالها إلى تبيان الدور الجوهري لهذا الفقه في ضبط الاجتهاد المعاصر وتوجيهه نحو تحقيق مقاصد الشريعة عند تعارض المصالح والمفاسد في القضايا الطبية. وقد اعتمدنا في معالجتنا لهذا الموضوع على المنهج الوصفي التحليلي لتوصيف النوازل، مع توظيف المنهج الاستنباطي لترجيح الأحكام الشرعية بناءً على ميزان الموازنة المقاصدية. وقد خلصنا في ختام هذا البحث إلى جملة من النتائج؛ أهمها أن فقه الموازنات يعد ضرورة اجتهادية لاغنى عنها في الحقل الطبي، حيث أثبتنا من خلال الدراسة وجوب العلاج الكيماوي لمرضى السرطان تغليباً لمصلحة "حفظ النفس"عند غلبة الظن بالشفاء. وفي المقابل، انتهينا إلى ترجيح منع جراحة رتق غشاء البكارة واستئصال رحم المختلة عقلياً؛ نظراً لرجحان المفاسد المترتبة عليهما، ولوجود بدائل طبية تحفظ الحقوق والكرامة. ونوصي في ختام دراستنا بضرورة تعميق التعاون بين الفقهاء والأطباء لضبط الموازنات في كل ما يستجد من قضايا طبية.  الكلمات المفتاحية: فقه الموازنات، المستجدات الطبية، مقاصد الشريعة،الترجيح الفقهي،حفظ النفس Summary : Our study centered on the topic "Jurisprudence of Balances (Fiqh al-Muwazanat) and its Impact on Medical Developments." Through this research, we sought to demonstrate the fundamental role of this jurisprudence in regulating contemporary legal reasoning (Ijtihad) and directing it toward achieving the higher objectives of Sharia (Maqasid al-Sharia) when interests and harms conflict in medical issues. In our treatment of this subject, we adopted a descriptive-analytical approach to characterize the medical developments, while employing a deductive approach to outweigh Sharia rulings based on the scale of purposive balancing. At the conclusion of this research, we reached several results; most notably that the Jurisprudence of Balances is an indispensable interpretive necessity in the medical field. Through the study, we proved the obligation of chemotherapy for cancer patients, prioritizing the interest of "preserving life" when recovery is most likely. Conversely, we concluded that the prohibition of hymenoplasty and hysterectomy for mentally disabled women is more likely, due to the preponderance of harms resulting from them and the availability of medical alternatives that preserve rights and dignity. At the end of our study, we recommend the necessity of deepening cooperation between jurists and physicians to regulate balances in all emerging medical issues.  Keywords: Jurisprudence of Balances (Fiqh al-Muwazanat), Medical Developments, Objectives of Sharia (Maqasid), Juristic Weighing, Preservation of Life.
