العالقات المالية بين الزوجين في الفقه والقانون

Abstract

فهذا بحث يهدف إلى تحديد مفهوم الذمة المالية وعالقتها بين الزوجين ، وموقف الشريعة اإلسالمية منه، وبيان شروطه وضوابطه وكيفية تنظيمه أثناء عقد الزواج، وكيفية تقسيمه بعد انتهاء العقد، وتكمن أهمية هذا البحث في كونه يناقش مسألة محورية تشغل الرأي العام في بعض المجتمعات اإلسالمية ومنها المجتمع الج ازئري، وهي مسألة المال المشترك بين الزوجين ومسألة النفقة الزوجية ومدى أحقية أحد الزوجين في األموال التي اشتركا في تحصيلها أثناء عقد الزواج. وسوف يعتمد البحث على المنهج االستقرائي التحليلي، وهو المنهج الذي يعتمد على جمع الحقائق والمعلومات ثم مقارنتها و تحليلها، بهدف الخروج بنتائج علمية صحيحة ودقيقة. الكلمات المفتاحية : اإلنفاق ، الذمة المالية ، اشتراك ، نفقة

Abstract

This research aims to define the concept of financial responsibility and its relationship between spouses, and the stance of Islamic law on it. It will also clarify its conditions, regulations, and how to regulate it during marriage contracts, as well as how to divide it after the contract ends. The importance of this research lies in its discussion of a central issue that concerns public opinion in some Islamic societies, including Algerian society. This issue is the matter of shared finances between spouses, spousal maintenance, and the extent of each spouse's entitlement to the funds they acquired during the marriage contract. The research will rely on the analytical-inductive method, which involves collecting facts and information, then comparing and analyzing them, with the aim of reaching accurate and precise scientific results.
