حوافز الاستثمار في ظل القانون 16-09 الوكالة الوطنیة لتطویر الاستثمار بالمسیلة

Abstract

جسد القانون 16-09 المتعلق بترقية الاستثمار، رغبة الجزائر في الانفتاح على الاستثمارات وإعطائها ديناميكية وحركية أكبر من خلال مجموعة من الضمانات القانونية والقضائية والتحفيزات الضريبية والإدارية التي جاء بها القانون، والتي لم تعرفها قوانين الاستثمار السابقة، وتهدف الجزائر بهذا إلى تحريك عجلة النمو الاقتصادي وتنويع المداخيل والاستغلال الأمثل للثروات المتاحة للخروج من التبعية لسوق المحروقات التي لم تعد مستقرة وهو ما أثر بشكل كبير على إيرادات الدولة، كما يظهر من خلال هذا القانون أن المشرع الجزائري قدم ضمانات عديدة للمستثمرين الأجانب مع ما يتماشى مع الاتفاقيات والمعاهدات الدولية كضمان المساواة بين المستثمرين وضمان استقرار أحكام هذا القانون، كما يضمن عدم نزع الملكية المستمر أو الاستيلاء عليها إلا في حالات خاصة، ويترتب عن ذلك تعویض عادل ومنصف، وضمن حق اللجوء إلى التحكيم و الوساطة الدوليين، أو إلى تحكيم خاص لحل المنازعات التي قد تنشا، كما منح للمستثمر حرية تحويل رؤوس الأموال والعائدات، وكل هذه الضمانات من شأنها أن تعطي دفع قوي للاستثمارات الأجنبية في الجزائر. Abstract: The Law of 16-09 on the promotion of investment, The desire of Algeria to open up to foreign investments and give it greater dynamism and mobility through a range of legal and judicial guarantees or tax and administrative incentives provided by the law and which are not defined by the previous investment laws, And Algeria aims to move the wheel of economic growth and diversify revenues and optimize the exploitation of the available resources out of dependence on the hydrocarbon market, which is no longer stable, which has greatly affected the revenues of the state, as evidenced by this law that the Algerian legislator provided many guarantees To foreign investors in accordance with international conventions and treaties such as guaranteeing the equality of investors and ensuring the stability of the provisions of this law. It also guarantees that the investor shall not be expropriated or seized except in special cases, resulting in fair and equitable compensation. International arbitration or special arbitration to resolve disputes that may arise, as well as granting the investor the freedom to transfer capital and proceeds, all these guarantees would give a strong impetus to foreign investments in Algeria.
