إجراءات المثول الفوري في التشريع الجزائري

Abstract

يعد إجراء المثول الفوري نقطة تحول مهمة في السياسة العقابية للمشرع الجزائري والذي استحدثه بموجب األمر 51_80 المؤرخ في 03جويلية0851،بسبب الضغط الشديد الذي تعرض له الجهاز القضائي نتيجة تكدس القضايا ،وذلك من أجل تبسيط وتسريع إجراءات المتابعة والمحاكمة، ويعتبر المثول الفوري بديل إلجراء التلبس ،حيث تتخذه النيابة العامة وفق مالئمتها اإلجرائية في إخطار المحكمة الجنحية بالقضايا المتعلقة بالجنح المتلبس بها والتي ال تحتاج إجراءات تحقيق خاصة، والذي بدوره يضمن محاكمة عادلة خالل فترة وجيزة دون المساس بالحقوق والحريات االساسية للفرThe immediate appearance procedure is an important turning point in the penal policy of the Algerian legislator, which was established by ordinance 15_02 of July 23, 2015, due to the intense pressure exerted on the judicial system due to the backlog of cases, in order to simplify and speed up supervision and judgment process. Immediate appearance is considered an alternative to flagrante delicto proceedings, as the public prosecutor takes it based on their procedural ability to notify the criminal court of cases related to flagrante delicto that do not require thorough investigation procedures, which guarantees a fair trial within a short time without prejudice to fundamental human rights and freedoms.
