The research on “Financial Penalties in Islamic Jurisprudence” discusses the nature of penalties imposed on wealth and property as a means of deterrence, discipline, and achieving the public interest. The study begins by establishing the conceptual framework of financial penalties and clarifying their relationship to discretionary punishment (taʿzir) and Islamic legal policy (siyasah sharʿiyyah). It explains that classical jurists did not formulate a comprehensive definition encompassing their modern forms, which necessitated proposing a definition that includes both traditional and contemporary applications. The research then examines the juristic ruling on financial penalties, highlighting the scholarly disagreement between those who prohibit them—based on the principle of the inviolability of wealth and the prohibition of unlawfully consuming people’s property—and those who permit them, relying on textual evidence and legal precedents that support financial punishment when it serves a legitimate public interest and avoids injustice. The study ultimately favors the view permitting financial penalties under strict Shariʿah regulations that ensure justice and prevent abuse. It also explores major contemporary applications such as fines, confiscation, freezing of assets, seizure of property, and economic boycotts, while clarifying their Shariʿah objectives and their economic and financial impacts, particularly in combating financial crimes and terrorism financing. The research concludes that financial penalties are legitimate means when governed by Islamic legal principles and directed toward preserving religion, life, wealth, and public security, while emphasizing the necessity of judicial and Shariʿah oversight to prevent misuse and maintain a balance between protecting society and safeguarding individual right | |
