الرقابة على الصفقات العمومية كآلية لمكافحة الفساد في التشريع الجزائري

Abstract

تعتبر الصفقات العمومية أهم أداة قانونية لتنفيذ الدولة لبرامجها التنموية وفي الوقت نفسه المجال األكثر خصوبة لتنامي ظاهرة الفساد. إذ يظهر ذلك من خالل أفعال تنطوي على إخالل الموظف العمومي بواجباته الوظيفية السيما واجبات النزاهة والحياد في سير المرافق العامة وفي التعامل مع المتعاملين االقتصاديين الفاعلين في هذا المجال، مما يستوجب تدخل المشرع بغية حماية هذا المجال الحيوي من هذه األفعال الماسة بالثقة العامة كذا والمصلحة العامة. وهذا ما تتناوله هذه األطروحة من خالل الوقوف على مضمون األحكام التي وضعها المشرع لبلوغ غاية تتمثل في الحماية السيما الجنائية للمال العام في مجال الصفقات العمومية. Abstract: Public procurements are the most important legal tool for the implementation of the state's development programs and at the same time the most fertile area for the growth of corruption. This is demonstrated by acts that involve a breach by a public official of his or her job duties, particularly the duties of integrity and impartiality in the functioning of public utilities and in dealing with economic operators active in this field, which requires the intervention of the legislator in order to protect this vital area from such acts that undermine public confidence and the public interest. This is what this thesis deals with by identifying the content of the provisions set by the legislator to achieve the goal of protection, especially criminal funds, in the field of public procurement.
