اختيارات الإمام ابن حبيب المالكي من خلال كتاب النوادر و الزيادات لابن أبي زيد القيرواني - كتاب الزكاة أنموذجا -

Abstract

هذا البحث بعنوان:" اختيارات الإمام ابن حبيب المالكيّ من خلال كتاب النّوادر و الزّيادات لابن أبي زيد القيرواني- كتاب الزّكاة أنموذجا-". من خلاله عرّفنا بعالِمين كبيرين معتبرين، فكتبهما، وأقوالهما لها مكانة مركزيّة في المذهب المالكيّ وهما: الإمام أبو مروان عبد الملك بن حبيب الأندلسيّ(ت:238ه)، والإمام ابن أبي زيد القيروانيّ(ت:386ه)، كما أنّنا عرّفنا بكتاب:(النّوادر والزّيادات)، الّذي هو عمدةٌ في جمع الرّوايات الموجودة، والمفقودة لأعلام المذهب المالكيّ، وقد درسنا في بحثنا هذا عشر مسائل كانت نماذج لاختيارات ابن حبيب المالكيّ وهي: مسألة زكاة الثّمار، و زكاة الكرسنة، و إخراج العين عن الحبّ، والتّخفيف في خرص النّخل، وفي الّذي يدير العرض بالعرض السّنة كلّها، هل يقوّم؟، وصفة زكاة الفوائد إذا كثرت، وهل تسقط الزّكاة إذا كان الدّين مهر زوجته؟، و من له مائتان مختلفتا الحول، و سنّ ما يُؤخذ في زكاة الغنم، وهل الرّكاز في أرض الصّلح أو العنوة لمن وجده؟. وقمنا ببيان أدلّة القول المشهور وأدلّة قول ابن حبيب، فوجدنا أنّ اختياراته كانت مبنيّة على أدلّة نقليّة وعقليّة متنوّعة، وأنّه لم يخالف أصول المذهب المالكيّ. ________________________________________

Summary: This research paper titled "The choices of Imam Ibn Habib AL Maliki " from the book -AL Nawadir Wa Al ziyadat" by Ibn Abi Zayd Al Qayrawani -The book of Zakat as a case study. Through this research , we introduced two prominent scholars whose books and juristic views hold a central position in the Maliki School of thought. Those two great scholars are Imam Abu Marwan Abd al-Malik Ibn Habib al-Andalusi (d. 238 AH), and Imam Ibn Abi Zayd al-Qayrawani (d. 386 AH). We introduced The Book AL Nawadir Wa AL Ziyadat which is a fundamental reference collecting the existing and the lost narrations of the leading figures of the Maliki School of thought. In this paper , we have analyzed ten issues which were samples of Ibn Habib Al Maliki's juristic choices namely: The issue of zakat on fruits, zakat on vetch(al- kirsinna), paying zakat in cash instead of grain, leniecy in estimating palm tree and whether merchandise that is continously trades throughout the year should be valued in money. The description of zakat on profits when they are abundant ,and whether zakat is waived if the debt is a wife's dowry, and the case of someone who has two hundred with different zakat years; and the age of sheep that is taken for zakat, and whether buried treasure (rikaz) found in land of a peace treaty or conquest belongs to the finder .We also presented the evidences of the well-known opinion and the evidences of Ibn Habib’s opinion.As a result ,we found that his choices were based on various transmitted and rational evidences, and that he did not oppose the principles of the Maliki School.
