الفروع الفقهية المخرجة على اصل المصالح المرسلة عند الصحابة -نماذج وتطبيقات

Abstract

تناولنا في بحثنا هذا موضوع الفروع الفقهية المخرجة على أصل المصالح المرسلة عند الصحابة رضي الله عليهم مقررين بذلك منهجهم الاستصلاحي الذي يبرز حجية المصالح المرسلة وكونها أصلا تبنى عليه الأحكام. وجبنا في رحاب المصلحة المرسلة منطلقين بطرح الاشكال التالي: هل منهاج الصحابة رضي الله عنهم يعد هديا في حجية المصالح المرسلة وكونها أصلا تبنى عليه الأحكام عند انعدام النص؟ وللإجابة عليه قسمنا البحث إلى ما يلي: مقدمة، وفصل تمهيدي عرفنا فيه المصطلحات الأساسية لعنوان البحث وفصلين أساسيين: الأول في الجانب النظري؛ قسمناه إلى ثلاثة مباحث؛ تناولنا فيه حقيقة المصلحة المرسلة وحجيتها وضوابط العمل بها ومجال إعمالها ومدى أهميتها وكذلك الفرق بينها وبين بعض المصطلحات المتقاربة (البدعة والاستحسان). والثاني الجانب التطبيقي الذي تطرقنا فبه إلى نماذج وتطبيقات في الفروع الفقهية المبنية على المصالح المرسلة عند الصحابة رضوان الله عليهم من خلال سبعة مباحث؛ الأول في بيان وقف الفاروق لسواد العراق والشام بين النص والاستصلاح مبرزين الخطأ الشائع في ذلك والثاني في باب العبادات المعقولة المعنى والثالث في المعاملات والرابع الحدود الشرعية الخامس الإدارية والعمرانية والسادس باب السياسة الشرعية والأخير الناحية العسكرية ثم ختمنا البحث بخاتمة وملخص عام له. وقد خلصنا دراستنا هذه إلى نتائج أهمها: أن الصحابة رضوان الله عليهم قد عملوا بالمصالح المرسلة في مختلف المجالات عند انعدام النص. الكلمات المفتاحية: الفروع الفقهية، التخريج، المصالح المرسلة، أصل، الصحابة.

Research summary : This research addresses the topic of jurisprudential branches (Furu’) derived from the principle of Maslaha Mursala (Unrestricted Public Interest) among the Companions (may Allah be pleased with them). It establishes their pro-welfare methodology (Manhaj Istislahi), which highlights the legal authority of Maslaha Mursala as a fundamental source upon which rulings are built. The study explores the dimensions of Maslaha Mursala by posing the following central problem: Does the methodology of the Companions serve as a guiding model for the authority of Maslaha Mursala and its status as a source of legal rulings in the absence of a specific text? To answer this question, the research is structured into an introduction, an introductory chapter defining key terminology, and two main chapters. The first chapter covers the theoretical framework, divided into three sections discussing the nature of Maslaha Mursala, its legal authority, conditions for its application, scope, importance, and its distinction from related concepts such as Bid’ah (Innovation) and Istihsan (Juristic Preference). The second chapter focuses on the practical application, examining models of jurisprudential branches based on public interest during the era of the Companions through seven sections. These include: Al-Faruq’s (Umar ibn al-Khattab) stance on the Sawad lands of Iraq and Syria between textual evidence and Istislah (correcting common misconceptions)., rational acts of worship, transactions, legal punishments (Hudud), administrative and urban matters, Siyasa Shar’iyya (legal governance), and military affairs. The research concludes with a final summary of the findings. The study reached several key results, most notably: The Companions applied Maslaha Mursala across various fields whenever a specific textual evidence was absent, demonstrating its necessity in ensuring the flexibility and comprehensiveness of Islamic Law.
