حماية القاصر في الشركة التجارية

Abstract

بناءا على ما تم التطرق إليه في هذا البحث يمكننا القول أن المشرع قد حاول حماية القاصر في الشركات التجارية سواء كانت شركات الأشخاص أو الأموال، رغم أن القاصر في الأصل لا يسمح له بالانضمام إليها ومزاولة التجارة، لكن لكل قاعدة استثناء، وعلى هذا الأساس فبانضمام القاصر للشركات التجارية تمنح له الصفة التجارية ، كما أن انضمامه لها يخلف عليه آثار بحيث يمتعه ببعض الحقوق ويلزمه ببعض الالتزامات، مما يترتب عليه عند مخالفتها لها مسؤولية قد تكون مدنية أو جزائية.

Abstract: Based on what was discussed in this research, we can say that the legislator has tried to protect the minor in commercial companies, whether it people’s companies or money, although the minor in the first place is not allowed to join it and practice trade, but every rule has an exception. On this basis, by the minor’s accession to commercial companies, he is granted commercial status, and his accession to them has effects so that he enjoys some rights and obliges him to some obligations, which entails when they violate it a responsibility that may be civil or penal.
