الأحكام الإجرائية الخاصة بجرائم التهريب في قانىن التهريب وقانىن الجمارك

Abstract

جرائم التهريب من أخطر الجرائم الاقتصادية التي تواجهها السياسة الاقتصادية الخارجية في المجتمعات الحديثة، وعدم ارتباطها بمكان وزمان معين نتج عنه أثار خطيرة على مجالات الحياة سواءً الاقتصادية والسياسية والاجتماعية وحتى الأمنية والثقافية منها، وفي هذا الإطار اتخذ المشرع الجزائري عدة إجراءات وأساليب منها ما هو منصوص عليه في قانون مكافحة التهريب، ومنها ما هو منصوص عليه في قانون الجمارك، ومنها ما هو منصوص عنه في قانون الإجراءات الجزائية وذلك للبحث والتحري عن جرائم التهريب ومكافحتها، كما أعطى حق متابعة جرائم التهريب للنيابة العامة في جانبها الجنائي، وإدارة الجمارك في جانبها المدني. الكلمات المفتاحية: التهريب، أثار التهريب، محضر المعاينة ومحضر الحجز، الدعوى الجبائية. Résume : Smuggling crimes are one of the most serious economic crimes that foreign economic policy faces in modern societies, and their lack of connection to a specific place and time has resulted in serious effects on all areas of life, whether economic, political, social and even security and cultural ones. In the Anti-Smuggling Law, including what is stipulated in the Customs Law, including what is stipulated in the Code of Criminal Procedure in order to search and investigate and combat smuggling crimes. It also gave the right to pursue smuggling crimes to the Public Prosecution in its criminal aspect, and the Customs Administration in its civil aspect.
