Abstract

The issue of proof in electronic contracts is of great importance in light of digital transformations, This study aims to analyze the adequacy of current legislation, such as Law No, 15-04 and Law No, 05-10 amending and supplementing Decree 75-58, in keeping pace with technical developments and adapting them to the rules of civil evidence. We relied on the descriptive and analytical approach to clarify the legislator's stance, Consequently, we divided the research into two chapters: the first addresses the admissibility of electronic documents in evidence, and the second examines the recognition of electronic signatures as a means of proof, The study concludes that while the legislative system has taken significant steps, judicial practice still faces practical difficulties that require updating procedural rules to ensure legal certainty and the stability of digital transactions.
