الموظف العام وعلاقته بالادارة في الوظيفة العمومية

Abstract

التي تتوقف عليها نشاطات الدولة في مختلف الميادين والمجالات، خاصة ما تعلق منها بإدارة المرافق العامة، ولعل من أهم الركائز الأساسية للوظيفة العمومية الموظفين العموميين الذين يعتبرون الأداة الرئيسية التي من خلالها تستطيع الدولة القيام بوظائفها وتحقيق أهدافها، وعليهم يتوقف السير الحسن والمنتظم للمرافق العامة. هذه الأهمية جعلت تحديد مفهوم الموظف العام وتكييف العلاقة القانونية بينه وبينه الإدارة من أكثر المواضيع إثارة للجدل بين الفقه والقضاء الإداري، وإن اتفقت جل تشريعات الوظيفة العامة في العالم ومن بينها الجزائر، على أن وصف الشخص بالموظف العام متوقف على أربعة شروط هي التعيين، ديمومة الوظيفة، الخدمة في مرفق عام والترسيم، وأخذت بالنظرية التنظيمية أو اللائحية في تكييف العلاقة القانونية بين الموظف العام والإدارة. كلمات مفتاحية: الموظف العام، الوظيفة العمومية، العلاقة القانونية، النظرية التعاقدية، النظرية التنظيمية، الخدمة في مرفق عام.

Abstract: The civil service sector in all countries, including Algeria, is one of the most important sectors on which the State's activities in various fields and areas depend, Especially with regard to the management of public utilities. Perhaps one of the most important pillars of the public service is public officials, who are the principal instrument through which the State can carry out its functions and achieve its objectives, and upon whom the good and orderly functioning of public utilities depends. This importance has made the definition of a public official and the adaptation of the legal relationship between the public employee and the administration one of the most controversial topics between jurisprudence and the administrative judiciary, although most of the legislation of the world's public service, including Algeria, has agreed that the description of a public official depends on four conditions, namely, appointment, durability of the post, service in a public facility and demarcation, and has introducedorganizational or regulatory theory in adapting the legal relationship between the public employee and the administration.
