Abstract

إنّ موضوع تنفيذ الأحكام الجنائية الأجنبية يعتبر من أهم مواضيع القانون الدولي الخاص، و ذلك للتطور الذي يشهده العالم في جميع مجالات الحياة، حيث لم تعد الجريمة تقتصر على حدود الدولة الواحدة فقد امتد تأثيرها ليمس المجتمع الدولي كافة، وبالتالي يجب مواكبة هذا التطور و تحديث آليات مكافحة الجريمة و ما يتوافق مع تطور ظاهرة الإجرام، و يعتبر التعاون الدولي في تنفيذ الأحكام الجنائية الأجنبية من أسمى مظاهر هذا التطور، و تتجلى أهمية هذا الموضوع أن لا تكون الحدود الإقليمية للدولة الحائل بين المجرم و تطبيق العقوبة عليه، و التوفيق بين استقلال كل دولة في ممارسة اختصاصها الجزائي على حدود إقليمها وبين ضرورة ممارسة حقها في العقاب من جهة، و مكافحة الجريمة على الصعيد الدولي و الوطني من جهة أخرى، و منع تفشي هذه الظاهرة بكافة صورها و أنواعها . ا The issue of the implementation of foreign criminal judgments is considered one of the most important topics of international private law due to the development witnessed by the world among all aspects of life. The crime is no longer limited to the borders of one state. It has extended its influence to the international community. The international cooperation aims to refresh the mechanisms against crime to be updated towards crime growth. Foreign criminal judgments is one of the most important aspects of this development, , on one hand The importance of this topic is to display that the territorial boundaries of the State should not be reconciled between the criminal and the application of the penalty, on the other hand the independence of each State in the exercise of its penal jurisdiction on the borders of its territory ought to be reconciled with the need to exercise its right in punishment in addition to fight crime at the two levels national and international in order to prevent the spread of this phenomenon in all its forms and types.
