الإذن الطبي في العمليات الجراحية المستعجلة في الفقه الإسلامي والقانون الجزائري -دراسة مقارنة

Abstract

يهدف هذا البحث إلى بيان أهمية موضوع الإذن الطبي في العمليات الجراحية المستعجلة والأحكام المنظمة له في الحالات التي يتعذر فيه الحصول على الإذن في كل من الفقه الاسلامي والقانون الجزائري بذكر مفهومه وأساسه الشرعي والقانوني وأنواعه وأركانه وشروطه. وتظهر أحكام الإذن الطبي في العمليات الجراحية المستعجلة من خلال بيان أثر الإذن الطبي في العمليات الجراحية المستعجلة والمسؤولية التي تقع على عاتق الطبيب في حال وجود الإذن وحال غياب الإذن الطبي في الفقه الاسلامي والقانون الجزائري وتوصلت من خلال الدراسة إلى أن الإذن الطبي يعتبر وسيلة لصيانة حقوق المريض والطبيب في الفقه الاسلامي والقانون الجزائري معا. الكلمات المفتاحية: الإذن الطبي، المريض، الطبيب، المسؤولية الطبية، الفقه الإسلامي. Abstract : This research aims to highlight the importance of medical consent in emergency surgical procedures and the legal regulations governing situations in which obtaining consent is impossible, from the perspectives of both Islamic jurisprudence and Algerian law. It examines the concept of medical consent, its legal and religious foundations, as well as its types, essential elements, and conditions. The study also clarifies the legal rulings related to medical consent in emergency surgical procedures by examining its impact on such procedures and the physician’s liability in cases where consent is present or absent, according to Islamic jurisprudence and Algerian law. The research concludes that medical consent serves as an important mechanism for protecting the rights of both patients and physicians in both Islamic jurisprudence and Algerian law.
