عدة المرأة وأحكامها عند المالكية "دراسة فقهية مقاصدية

Abstract

تعنى هذه الدراسة ببيان أحكام عِدّة المرأة في الفقه المالكي من منظور فقهي مقاصدي، بالتركيز على مشروعيتها، وأنواعها، وأحكامها التكليفية وآثارها، وتتبع مقاصدها الشرعية وصولاً إلى نوازلها المعاصرة. وتقوم الدراسة على المنهج الوصفي الاستقرائي التحليلي لتتبع فروع مسائل العدة في مدونات المذهب واستنباط غاياتها التشريعية. وتُشير النتائج إلى أن العدة حكم شرعي يجمع بين التعبد وصيانة الأنساب وتحقيق مقاصد نفسية واجتماعية، وتُظهر شمولية الفقه المالكي وقدرته على معالجة المستجدات الطبية والاجتماعية، ويخلص البحث بتوصية اللجان العلمية بكليات العلوم الإسلامية بالاهتمام بالبحوث المتعلقة بالمرأة وأحكامها الشرعية وتشجيع تناولها في مذكرات التخرج. الكلمات المفتاحية: العدة، المذهب المالكي، أحكام شرعية، المقاصد، النوازل المعاصرة.

Abstract: This study addresses the rulings of a woman's Iddah within Maliki jurisprudence from a jurisprudential and objective perspective، focusing on its legitimacy، types، legal rulings، effects، and Sharia objectives down to its contemporary issues. The research relies on the descriptive، inductive-analytical method to trace Iddah issues in the school's manuals and deduce their legislative purposes. The results indicate that Iddah is a legal ruling combining worship، preservation of lineages، and psychological and social objectives، demonstrating the comprehensiveness of Maliki jurisprudence in dealing with medical and social developments. The research recommends that scientific committees in colleges of Islamic sciences pay attention to research related to women and their legal rulings، encouraging their inclusion in graduation theses.
