Abstract

إن موضوع بحثنا هذا كان في استقراء أسباب الخلاف عند ابن بشير من خلال كتابه التنبيه على مبادئ التوجيه- الجمعة والجنائز- نموذجا، وقد حوى بحثنا هذا ؛ فصلا تمهيديا وفصلين رئيسين؛ للتعريف بالإمام واستقراء أسباب الخلاف وكل فصل حوى مطالب انضوى تحت كل مطلب مجموعة من الفروع ،على حسب ما يتطلبه البحث . ولقد توصلنا إلى أن ابن بشير؛ عالم أصولي، فقيه، مالكي، يهتم بالتدليل والتعليل وإبراز أسباب الخلاف في نسق تأصيلي دقيق؛ يدل على تضلعه في الفقه وأصوله ودرايته التامة بأصول المذهب المالكي ومناط الأحكام. وختمنا بحثنا هذا بمجموعة من التوجيهات والتوصيات المرجوة من ورائه.

Summary search: Research Abstract: The subject of this research is "The Reasons for Disagreement According to Ibn Bashir through his book Kitab al-Tanbih". This research includes a preliminary chapter and two main chapters. The preliminary chapter covers the principles of al-Tawjih, al-Jumu'ah (Friday prayer), and al-Jana'iz (funerals), and represents the core demands of the research. Each chapter is divided into sections as required by the research, organized under a set of branches of jurisprudence (furu') from the Maliki school of thought, explaining and analyzing them. We have reached the conclusion that Ibn Bashir, the jurist and scholar of legal theory (Usuli), excelled in presenting the reasons for disagreement in a precise, detailed manner that demonstrates his deep understanding of Maliki jurisprudence, its principles, and the derivation of rulings. We concluded our research with a collection of the recommendations and findings derived from it.
