Abstract

ي استقرار األسرة وحماية كيانها من أي خطر أو ضرر مقصدا شرعيا وقانونيا فجاء الصلح من خالل قوانين وإجراءات لحفظ العالقة الزوجية من األخطار واألضرار وأسباب االنهيار، فالشريعة اإلسالمية تدعو إليه وتحرص عليه، وتحقيقا لذلك شرع الصلح بين الزوجين كخيار لتحقيق ديمومة االستقرار األسري، وفض أسباب الخصومة التي قد تنتهي بفك الرابطة الزوجية وانهيار كيان األسرة، وتشريد أفرادها ولهذا الغرض تهدف دراستنا إلى أن االلتزام بالطريقة الشرعية في إنهاء األحكام، واألمر بإصالح ذات البين وتقديم خطوات عملية لفض النزاعات وإنهاء الخصومات، كذلك بيان دور القاضي في عرض الصلح على الخصوم من خالل بيان أثر الصلح على أطراف النزاع، واتبعنا في انجازنا لهذ العمل على المنهج الوصفي التحليلي ألنه األنسب لذلك، كما توصلنا في نهاية دراستنا الى عدة نتائج أهمها أن الصلح بين الزوجين يعتبر من أهم السبل للحفاظ على األسرة ووحدتها، فصالح المجتمع من صالح االسرة، لهذا ال بد من نشر الوعي الشرعي بأحكام األسرة وتنمية الوازع الديني لدى الزوجين، مع عمل إرشادي في قضايا األسرة. الكلمات المفتاحية: الصلح، التشريع الج ازئري، األسرة، الخصومة، الفقه االسالمي.

Abstract : The stability of the family and the protection of its entity from any danger or harm is considered as a Sharia and justice goal. Reconciliation came through laws and procedures to protect the marital relationship from dangers, damages, and causes of collapse. Islamic law calls for it and is keen on it. To achieve this, reconciliation between spouses was legislated as an option to achieve the continuity of family stability and resolve the causes of disputes that may end in the dissolution of the marital bond, the collapse of the family entity, and the displacement of its members. For this purpose, our study aims to adhere to the legitimate method of finalizing judgments, ordering reconciliation between disputes, and providing practical steps to resolve disputes and end disputes, as well as clarifying the role of the judge in offering reconciliation to the adversaries by explaining the impact of reconciliation on the parties to the dispute, and in completing this work we followed the method Descriptive and analytical because it is the most appropriate for this. At the end of our study, we reached several results, the most important of which is that reconciliation between spouses is considered one of the most important ways to preserve the family and its unity. The good of society is the good of the family. Therefore, it is necessary to spread legal awareness of the family rulings and develop the religious motivation of the spouses, along with guidance work on issues Family.
