Abstract

Abstract
This study aims to explore the features of Ibn Habib's jurisprudential personality, and to prove his eligibility for independent legal reasoning (ijtihad) by analyzing his jurisprudential choices, and highlighting a talent that takes evidence as a guiding principle in its choices, even if it did not abandon the mantle of affiliation with the imam of the school of thought in many of its principles, and this was manifested in:
1. Introductory Chapter: Devoted to introducing Ibn Habib (his personality, works, and scholarly rank) as a foundation for revealing his jurisprudential choices. This is followed by an introduction to a leading imam of the school, Ibn Abi Zayd, following the same approach.
2. Recording Ibn Habib's Choices: Within Ibn Abi Zayd's compendium, given his prominence — both specifically in relation to Ibn Abi Zayd and generally among Maliki scholars.
3. Defining the Term "Ikhtiyar" (Juristic Choice): In relation to the "Mashhur" (the dominant opinion), since every ikhtiyar necessarily stands in contrast to a mashhur. Judging something requires first understanding its nature.
4. Case Studies: Presenting selected examples from Ibn Habib's jurisprudential choices through a comparative study within the Maliki school itself, and in comparison, with other legal schools.
Conclusion: The study concludes by assessing the value and soundness of these choices, demonstrating that the preponderant opinion — in the cases examined — tends to favour Ibn Habib's jurisprudential choice.
