Abstract
Abstract:
This study examines the role of Preponderance via Sharia Objectives (Tarjih al-Maqasidi) within specific rules of Prohibition (Nahi). It investigates the profound impact of Sharia objectives in weighing conflicting jurisprudential opinions related to fundamental principles of prohibition. Furthermore, it highlights the significance of these objectives in fostering an accurate understanding of textual evidence (Nass) and applying legal rulings to practical realities in a manner that secures the welfare of accountables (Masalih al-Mukallafin) and averts harm (Mafasid) from them.
The research is structured into two main chapters:
● The First Chapter: Establishes the conceptual and theoretical framework of preponderance based on Sharia objectives.
● The Second Chapter: Delineates the jurisprudential reality of prohibition according to legal theorists (Usuliyyin), examining its fundamental rules and their practical applications in light of Maqasidi preponderance.
The study concludes that Sharia objectives serve as paramount criteria for determination when disagreement or apparent contradiction arises regarding the implications of prohibition. Conserving the five necessities—religion, life, intellect, lineage, and wealth—significantly contributes to favoring rulings that optimize human welfare and harmonize with the overarching objectives of Sharia. Finally, the findings reveal that the rules of prohibition are by no means abstract concepts; rather, they are inherently intertwined with Sharia objectives that guide their interpretation and contextual application across various contemporary issues and legal realities.
