إف إتجاه إرادة الجوؿ إلى عقج السعاىجات الجولية لسكافحة الجخائع الجولية يشتج عشو إلتداـ الجولة بتصبيق السعاىجة عمى الرعيج الجاخمي، وفي سبيل ذلظ كاف البج مغ تحجيج مكانة السعاىجة داخميا، تبيغ مغ حيث تبشى السذخع الجدائخؼ نطخية وحجة القانػف مع سسػ السعاىجة عمى القانػف وىػ ما ي نز السادة 154 مغ الجستػر، لكغ التداـ القاضي بتصبيق السعاىجة داخميا يفخض عميو تفديخىا جولية والجاخمية لفظ تعارض السعاىجة سػاء مع القانػف الجولي او الجاخمي ؼيصبق القاضي القػاعج ال أوال، وىػ ما أدػ بالسذخع الجدائخؼ إلى مشح ميسة تفديخ السعاىجة لػزيخ الخارجية، اما في حالة التعارض . Summary The direction of the will of states to conclude international treaties to combat international crimes results in the commitment of the state to implement the treaty at the internal level, and for this it was necessary to determine the status of the treaty internally, as the Algerian legislator adopted the theory of the unity of law with the supremacy of the treaty over the law, which is evident from the text of Article 154 of the constitution, but the judge’s obligation to implement the treaty internally requires him to interpret it first, which led the Algerian legislator to give the task of interpreting the treaty to the Minister of Foreign Affairs, but in the event that the treaty conflicts with either international or domestic law, the judge applies international and internal rules to resolve the conflict .
