Abstract

معظم التشريعات القانونية تعترف بمبدأ الدفاع الشرلي كأحد أسباب اإلباحة لرد االلتداء ،وذلك بتوافر الشروط الضرورية في فعل االلتداء لينشأ الحق لممعتدى لميو في الدفاع لن نفسو ،وأن يكون واذا تجاوز المدافع حدود الدفاع الشرلي ،فإن فعمو يخرج من فعل الدفاع الزما ومتناسبا مع االلتداء ، نطاق اإلباحة ويعود إل أصمو كفعل غير قانوني يمكن تجريمو، وفي غياب نص خاص يحكم التجاوز في التشريع الجزائري ،يتم تطبيق القوالد العامة في ىذا الشأن. الكلمات المفتاحية الدفاع الشرعي ،االعتداء ،فعل الدفاع ،تجاوز. Abstract Most modern legal systems recognize the principle of justifiable self-defense as a basis for the exemption of criminal liability in response to an attack. however ; this recognition is contingent on the fulfilment of certain necessary conditions that must be present in the act of aggression for the right to defend oneself to arize ;the defensive act itself must be necessary and proportionate to the attack ;if the defenser exceeds the boundaries of justifiable self defense .the defender faces criminal liability ;and if a defender goes past these restrictions ;they may face legal consequences and be held accountable for their acts that go beyond the authorized limits of self-defense.
