Abstract

تناولت هذه الدراسة بحث "تجزؤ الاجتهاد وأثره في المسائل الفقهية المعاصرة"، حيث تعتبر هذه المسألة من ابواب الاجتهاد المهمة التي درسها علماء الأصول في كتبهم ومتونهم، وقد أفردناها بالدراسة في هذا البحث. ولتجزؤ الاجتهاد مفهوم واسع وأثر بالغ في بناء الأحكام الفقهية المعاصرة، حيث إن الاجتهاد المطلق متعذر في هذا الزمان فيرجع بناء الأحكام للمسائل الفقهية المعاصرة لتجزؤ الاجتهاد باعتباره الآلية المناسبة والوحيدة للبتِّ فيها وإظهار حكمها، والقول بتجزؤ الاجتهاد عين الصواب والقول بخلافه في هذا العصر مطرّح. الكلمات المفتاحية: الاجتهاد، تجزؤ الاجتهاد، المسائل الفقهية المعاصرة. This study examines the research topic titled 'The Divisibility of Ijtihad and its Impact on Contemporary Jurisprudential Issues.' This matter is considered one of the vital chapters of Ijtihad (independent juristic reasoning) that outlines the works and classical texts of the scholars of Usul (principles of jurisprudence), and we have dedicated this research to its exclusive study. The divisibility of Ijtihad carries a broad conceptual framework and a profound impact on the construction of contemporary jurisprudential rulings. Given that absolute Ijtihad (Al-Ijtihad al-Mutlaq) is unattainable in this day and age, the derivation of rulings for contemporary jurisprudential issues relies on the divisibility of Ijtihad, as it constitutes the appropriate and sole mechanism to resolve them and elucidate their legal status. Therefore, the view supporting the divisibility of Ijtihad is entirely correct, and any contrary view in this era is utterly untenable.
