آليات تسوية منازعات الضمان االجتماعي

Abstract

لقد دعمت منظومة الضمان االجتماعي في الج ازئر بقوانين معدلة ومتممة للقانون الصادر في سنة ،1983 الذي سعى إلى تفعيل آليات التسوية الداخلية في الفصل في المنازعات في مجال ضمان االجتماعي، إال أن هذا القانون لم يحقق األهداف المرجوة، مما دفع المشرع إلى إد ارج قانون جديد رقم -08 08 المؤرخ في 23 فيفري 2008 والمتعلق بالمنازعات في مجال الضمان االجتماعي، والذي أضاف تعديالت جوهرية ومميزة تتعلق باآلجال القانونية وآجال الطعن أمام اللجان المؤهلة للطعن والفصل في هذه الطعون، باإلضافة إلى تحديد اختصاص لجان الطعون. الكلمات المفتاحية: منازعات الضمان اإلجتماعي، التسوية الداخلية، التسوية القضائية، الطعون، اللجان.

Abstract: The social security system in Algeria has been supported by laws amending and supplementing the law issued in 1983, which sought to activate internal settlement mechanisms in the adjudication of disputes in the field of Social Security, but this law did not achieve the desired goals, which prompted the Legislature to include a new law No. 08-08 dated February 23, 2008 on disputes in the field of Social Security, which added substantial and distinctive amendments related to the legal deadlines and appeal deadlines before the committees qualified to appeal and adjudicate these appeals, in addition to defining the jurisdiction of Appeals Committees.
