Abstract
environment is the main pillar of this universe, and it must be preserved
from the damage it suffers from pollution or irrational exploitation of its resources,
and this is what prompted the countries of the world to speed up the activation of
mechanisms to confront this threat, and Algeria was one of the countries that rushed
to enact laws and procedures aimed at minimizing damage at the national level
through various central and local mechanisms.
Administrative law is distinguished from other branches of law in that its protection
of the environment is intended in the sense of preventing the occurrence of damage
by avoiding the causes of pollution that harm the environment.
The enactment of legislation in the protection against environmental pollution
resulting from natural disasters did not exempt the administration from its
responsibility for the damage that results from its work or in connection with it, in
every form, immediate, future, local or long-term. All this called for the creation of
compensatory mechanisms for those affected. If he meets a number of formal
conditions, he has the right to benefit from compensation in two forms, either moral
or monetary compensation
