أقضية الإمام علي-رضي الله عنه- – نماذج مختارة -

Abstract

يهدف هذا البحث إلى تسليط الضوء على أقضية الإمام علي بن أبي طالب-رضي الله عنه-، والتي برز فيها وتميز بفطنة وعبقرية لافتة، لم يسبقه بها أحد، والذي يعد من المدارس الأولى في القضاء الإسلامي، وذلك من خلال التطرق لمفهوم القضاء و ما يتعلق به، و التعرف على حياة الإمام علي-رضي الله عنه- الشخصية والعلمية، وكيف تصدر الصحابي الجليل هذا المنصب حتى أنّ أصبح أقضاهم، وأيضا من خلال جمع لبعض الأقضية كنماذج مختارة من أشهر الأقضية المأثورة عن سيدنا علي-رضي الله عنه-، حيث تأكد لنا أنّ عليا-رضي الله عنه- موسوعة قضائية فقهية يرجع لها لحل القضايا العويصة، كما يأخذ منّ أقضيته لتصبح كنموذج سامي في النظام القضائي الإسلامي. وبهذا تظهر صالحية الشريعة الإسلامية لكل زمان ومكان، كما يظهر مدى فقه الصحابة-رضوان الله عليهم-، وكيف أنّ حفظ الله بهم هذا الدين. الكلمات المفتاحية: القضاء في الفقه الإسلامي، الإمام علي-رضي الله عنه-، أقضية الإمام علي-رضي الله عنه- The Abstract: This research aims to shed light on the judicial rulings (aqdiyah) of Imam Ali ibn Abi Talib (may Allah be pleased with him), in which he excelled and distinguished himself with remarkable astuteness and genius, unmatched by anyone before him. He is considered one of the earliest schools in Islamic jurisprudence, by addressing the concept of judiciary and related matters, and by exploring the personal and academic life of Imam Ali (may Allah be pleased with him). It will also examine how this great companion ascended to this position, becoming the most knowledgeable in judicial matters, and will present a collection of selected rulings as examples of the most famous judgments attributed to Sayyiduna Ali (may Allah be pleased with him). This confirms that Ali (may Allah be pleased with him) was a jurisprudential and judicial encyclopedia, referred to for resolving complex cases, and his rulings serve as a sublime model in the Islamic judicial system. This demonstrates the applicability of Islamic Sharia for all times and places, and highlights the profound jurisprudence of the Companions (may Allah be pleased with them), and how Allah preserved this religion through them.
