قاعدة "الأصل في البيوع الإباحة" وتطبيقاتها على البيوع المعاصرة -دراسة على نماذج مختارة

Abstract

تناولت هذه الدراسة تطبيقات لقاعدة "الأصل في البيوع الإباحة" على نماذج من البيوع المعاصرة، وقد تمحورت الإشكالية حول مدى إمكان الاعتماد على هذه القاعدة في الحكم على هذه البيوع بالجواز، وكان هدف البحث هو معرفة كيفية تخريج هذه البيوع على هذه القاعدة أولا، ومقارنة ذلك مع الأدلة الناقلة عن أصل الإباحة ثانيا. ولأجل تحقيق هذا الهدف فقد تم اعتماد المناهج التالية: التحليلي، الاستقرائي والمقارن. وأظهرت النتائج أن قاعدة "الأصل في البيوع الإباحة" قاعدة صحيحة، وهي أهم قاعدة في باب البيوع، ويمكن أيضا الاعتماد عليها في استنباط حكم الإباحة للبيوع التي لم يرد بشأنها دليل خاص بالحل أو الحرمة. الكلمات المفتاحية: القاعدة، البيوع، أصل الإباحة، الفقه، التطبيقات المعاصرة. Abstract This study examined the application of the juristic maxim "The original ruling regarding sales transactions is permissibility" to examples of contemporary sales transactions, the research problem emphasized the extent to which this maxim can be relied upon to determine the permissibility of such transactions. The study aimed firstly to understand how these contemporary transactions might be juristically derived from this maxim, and secondly to compare this interpretation with the evidences that do not support the original permissibility. To achieve the goal, analytical, inductive and comparative methods were employed. The findings indicated that "The original ruling regarding sales transactions is permissibility" is valid maxim, and indeed is the most important maxim in the field of sales transactions. It also might be relied upon to derive permissibility for sales transactions, which have no specific evidence regarding either permissibility or prohibition.
