الكفـــــــاءة في الزواج وأثرها على استقرار الأسرة في الفقه الإسلامي وقانون الأســـرة الجزائري- دراسة مقارنة

Abstract

شرع الله جل وعلا منظومة الزواج بهدف استبقاء الجنس البشري وحمايته وضبط هذا الميثاق الغليظ بمعايير تضمن متانته وفي طليعتها "الكفاءة بين الزوجين"؛ حيث يؤدي تحقق هذا الضابط إلى توطيد دعائم الألفة والوئام داخل الأسرة المسلمة ويؤمن ديمومة استقرارها وسكينتها. وفي مقابل ذلك، يترتب على غياب التكافؤ وهن البناء الأسري ونشوب الخلافات التي تنتهي غالباً بالانفصال القضائي ومن هذا المنطلق؛ تسعى هذه الدراسة المقارنة إلى استجلاء المعالجة الفقهية والقانونية لتبعات الكفاءة حضوراً وعدماً. الكلمات المفتاحية: الكفاءة، الزواج، استقرار الأسرة، فك الرابطة الزوجية، الفقه الإسلامي. Abstract: Allah Almighty ordained the institution of marriage to preserve and protect the human race, surrounding this solemn covenant with criteria to ensure its durability, foremost of which is "marital compatibility". The fulfilment of this criterion consolidates the foundations of harmony and affection within the Muslim family, securing its long-term stability and tranquillity. Conversely, the absence of compatibility results in the weakening of the domestic structure and the eruption of disputes that often culminate in judicial separation Accordingly, this comparative study aims to elucidate the jurisprudential and legal treatment of the consequences of compatibility-both in its presence and absence.
