Abstract

Abstract
This study examines the right of non-Muslims to practice their religious rites in Algeria as one of the fundamental rights associated with freedom of religion and belief, which has received increasing attention at both the national and international levels within the framework of human rights protection. The study aims to explore the extent to which this right is recognized in Islamic law and regulated under Algerian legislation, while highlighting the points of convergence and divergence between Islamic jurisprudence and the Algerian legal system.
The research adopts descriptive, analytical, and comparative approaches by examining relevant Islamic sources, constitutional provisions, legal texts, and regulatory frameworks governing the exercise of religious rites by non-Muslims in Algeria.
The findings reveal that Islamic law recognizes the right of non-Muslims residing in an Islamic state to practice their religious rites in an atmosphere of tolerance and mutual respect, while ensuring the protection of their places of worship and preserving their human dignity. However, the exercise of this right is subject to certain regulations intended to safeguard public order and social harmony.
The study also demonstrates that Algerian legislation guarantees freedom of worship for non-Muslims through constitutional provisions and a number of legislative and regulatory texts, particularly Ordinance No. 06-03 governing the conditions and rules for the practice of religious rites by non-Muslims, in addition to the provisions of the Penal Code that criminalize acts obstructing religious practices or violating places of worship. Nevertheless, the exercise of this right remains subject to legal procedures aimed at maintaining public order and protecting national cohesion.
The study concludes that there is a significant degree of consistency between the principles of Islamic law and Algerian legislation regarding the recognition of the right of non-Muslims to practice their religious rites, although differences exist in the mechanisms of regulation and legal guarantees. It further recommends strengthening the legal framework protecting religious freedom, clarifying the applicable legal provisions, and promoting a culture of religious tolerance, peaceful coexistence, and mutual respect in order to reinforce citizenship, human rights, and social stability.
