Abstract

Abstract
This study aims to highlight the Istisna' contract and its contemporary applications in Islamic banks in Algeria, with a focus on a field study of Al Salam Bank (M’Sila branch). The study is divided into two main chapters. The first chapter addresses the conceptual and jurisprudential framework of the Istisna' contract, reviewing its linguistic and juristic definitions, its legitimacy, its pillars and conditions (including the condition of the term), as well as its jurisprudential adaptation, characteristics, and its distinction from other contracts such as Salam and Ijarah. The second chapter is devoted to the applied field study at Al Salam Bank in M’Sila, where the mechanisms for implementing Istisna' and parallel Istisna' (Istisna' Mudaf) in real estate financing, financing the construction and development of homes for individuals, as well as financing industrial projects and small and medium-sized enterprises (SMEs), were analyzed.
The study began with fundamental hypotheses positing that Istisna' represents an innovative and effective financing instrument in Islamic banks, that its adoption contributes to meeting housing needs in accordance with Sharia principles, and that the implementation of parallel Istisna' enhances the banks' capacity to finance small and medium-sized economic projects. The findings conclude that Al Salam Bank successfully utilizes the Istisna' contract as a tool for real estate and housing finance, in addition to supporting industrial projects and SMEs. This contributes to enhancing economic development, expanding the range of Sharia-compliant financial products, and strengthening customer confidence in Islamic banking transactions.
