تغير الاجتهاد والمسائل الفقهية المترتبة عليه

Abstract

تناول هذا البحث موضوع تغيّر الاجتهاد من حيث مفهومه وأسبابه ومشروعيته وضوابطه وآثاره، وتم تقسيمه إلى فصلين؛ خُصِّص الأول لبيان مفهوم تغيّر الاجتهاد وأسبابه ومشروعيته والضوابط الحاكمة له، بينما عُني الثاني بدراسة آثاره في حق المجتهد والمقلّد والمجتهد فيه، وانعكاساته على الواقع الفقهي، واعتمد البحث على المنهج الاستقرائي في جمع المادة العلمية وتحليلها، وتوصّل إلى جملة من النتائج، أبرزها أن تغيّر الاجتهاد هو عدول المجتهد عن رأيه السابق إلى رأي آخر لقيام موجب معتبر يقتضي ذلك، وأنه أمر مشروع تدل عليه النصوص الشرعية والعقل وإجماع العلماء، بما يبرز مرونة الشريعة الإسلامية وقدرتها على مواكبة المستجدات. كما أوصى البحث بإنشاء هيئة علمية متخصصة تُعنى بمراجعة الاجتهادات الفقهية وتنقيحها في ضوء المستجدات والضوابط الشرعية. الكلمات المفتاحية: الاجتهاد، تغيّر الاجتهاد ومشروعيته، أسباب تغيّر الاجتهاد، ضوابط تغيّر الاجتهاد، الآثار والمسائل الفقهية. This research addresses the topic of "the changing of Ijtihad" (independent juristic reasoning) in terms of its concept, causes, legitimacy, regulations, and effects. The study is divided into two chapters; the first is dedicated to clarifying the concept of changing Ijtihad, its causes, legitimacy, and governing regulations, while the second focuses on studying its effects on the Mujtahid (juristic scholar), the Muqallid (follower/layperson), and the subject matter of Ijtihad, as well as its impact on contemporary jurisprudential reality. The research relied on the inductive method for collecting and analyzing scientific material, and reached a number of conclusions. Most notably, that the changing of Ijtihad is the departure of a Mujtahid from their previous opinion to another due to a valid legal justification that necessitates doing so. Furthermore, it is a legitimate practice supported by Sharia texts, reason, and scholarly consensus (Ijma'), highlighting the flexibility of Islamic Sharia and its capacity to keep pace with contemporary developments. The research also recommended establishing a specialized academic body dedicated to reviewing and refining jurisprudential Ijtihads in light of modern developments and Sharia regulations.
