جرائم الصفقات العمومية في التشريع الجزائري

Abstract

من أهم تعاريف الصفقات العمومية: " أنها العمليات التي تبرم بين طرفين أحدهما ممثل الإدارة العمومية مع احدي المؤسسات العامة أو الخاصة من أجل انجاز أشغال تهدف إلي تقديم خدمة عمومية " ومن أجل تحديد الجرائم التي تمس بهذه الصفقات سن المشرع الجزائري جملة من القوانين خاصةالتي تنظيم تشريع الصفقات العمومية وتفويضات المرفق العام المنصوص عليه بموجب المرسوم الرئاسي 15-247 والذي احتوى آليات جديدة تضمن التطبيق الأمثل لهذا التشريع عن طريق سلطة ضبط الصفقات العمومية وتفويضات المرفق العام . وقبل ذالك بصدور القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته وهي أهم القوانين التي حصرت هذه الجرائم، وباستحداثها لجريمة تعارض المصالح،وإعادة صياغة الجرائم الاخري (الملغاة) من قانون العقوبات ،وهذا كله استجابة لالتزام الدولة في إطار مكافحة الفساد وتحقيقا للردع من هذه الجرائم وفق سياسة جنائية تعمل عليه الدولة لحماية المال العام . Abstract One of the most important definitions of the Public Procurements is the multiple operations entered between one of the representatives of the Public Administration and one of the two institutions: the public or the private institution. The objective is to achieve works aimed to provide a public service. And in order to focus on the crimes concerned by this procurement, the Algerian legislator enact several laws, specially the laws that organize the Public Procurements and the delegations of Public Service legislations set out by the Presidential Decree No.247-15 on incorporating new mechanisms to ensure optimal application of this legislation through the authority of the Public Procurements Control and the delegations of Public Service. Prior to this, the promulgation of law No.01-06 on preventing and controlling corruption; is one of the most important laws that limitate this kind of crimes, created to oppose the interests and reformulate the other crimes (concealed) from the Penal Code. All this response the state obligation in the fight against corruption and to achieve deterring this crimes, in accordance with criminal policy the state working on; to protect the public funds.
