Abstract
تعالج هذه الدراسة التشريعات الإعلامية الجديدة التي صدرت في الجزائر لسنة 2023، والمتمثلة في القانون العضوي للإعلام رقم 23-14، وقانون الصحافة المكتوبة والإلكترونية رقم 23-19، وكذا قانون النشاط السمعي البصري رقم 23-20، في ظل التحولات الرقمية التي مست قطاع الإعلام. وتهدف إلى تحليل مدى قدرة هذه القوانين على تحقيق التوازن بين حرية الصحافة ومتطلبات الضبط القانوني.
تنطلق الدراسة من إشكالية رئيسية تتمثل في: كيف ساهمت قوانين الاعلام الجزائري لسنة 2023 في ضبط الممارسة الإعلامية بمراعاة التطورات القائمة دون المساس بحرية التعبير. وقد تم الاعتماد على المنهج الوصفي والمنهج التحليلي القانوني لدراسة النصوص التشريعية وربطها بالمبادئ الدستورية.
وتوصلت الدراسة إلى أن هذه القوانين كرّست حرية الصحافة من حيث المبدأ، وأدخلت مستجدات تنظيمية ومفاهيمية لمواكبة التطور الرقمي، غير أنها وسّعت في المقابل من نطاق الضبط القانوني، خاصة من خلال تعزيز شروط التنظيم ونظام المسؤولية. كما بيّنت أن فعالية سلطات الضبط تبقى مرتبطة بمدى استقلاليتها. وتخلص الدراسة إلى أن التشريعات الإعلامية لسنة 2023 حققت توازنًا نسبيًا بين الحرية والتنظيم، إلا أنها لا تزال بحاجة إلى تطوير لضمان ممارسة إعلامية أكثر حرية وفعالية.

Abstract:
This study examines the new media legislation enacted in Algeria in 2023, namely Organic Law No. 23-14 on Information, Law No. 23-19 on Print and Electronic Press, and Law No. 23-20 on Audiovisual Activity, in light of the digital transformations affecting the media sector. It aims to analyze the extent to which these laws achieve a balance between press freedom and the requirements of legal regulation.
The study begins with a central question: How have the Algerian media laws of 2023 contributed to regulating media practice while taking into account current developments without compromising freedom of expression? The descriptive and legal analytical methods were employed to examine the legislative texts and link them to constitutional principles.
The study concluded that these laws, in principle, enshrined press freedom and introduced new regulatory and conceptual frameworks to keep pace with digital developments. However, they also broadened the scope of legal regulation, particularly by strengthening regulatory requirements and the system of accountability. Furthermore, the study demonstrated that the effectiveness of regulatory authorities remains contingent upon their independence. The study concludes that the 2023 media legislation achieved a relative balance between freedom and regulation, but still requires further development to ensure freer and more effective media practice.
