وقف تنفیذ القرارات الإداریة في ظل قانون الإجراءات المدنیة والإداریة الجزائري

Abstract

إن نظام وقف تنفيذ القرا رت الإدارية لا يقل أهمية عن الدعاوى الإدارية الأخرى، إذ يلجأ إليها الأفراد بغية حماية حق من حقوقهم التي كفلها القانون. وعليه قمنا بد ا رسة نظام وقف تنفيذ القرا رت الإدارية وفقا لقانون الاجراءات المدنية والادارية، بحيث تضمنت هذه الد ا رسة الطبيعة القانونية لنظام الوقف، باعتباره كإجراء استثنائي عن المبدأ الأثر غير الموقف للطعن بالإلغاء، وذلك من أجل سد العيوب المترتبة عن هذا المبدأ والمتمثلة في طول اجراءات التقاضي والتي تستغرق وقتا طويلا بين مرحلة صدور القرار والحكم في دعوى إلغاء القرار الإداري، كما تضمنت هذه الد ا رسة الشروط الشكلية والموضوعية لوقف تنفيذ القرار الإداري سواء أمام قاضي الموضوع أو أمام قاضي الاستعجال، بحيث تصدر أوامر وقتية من القاضي المختص وقطعي فيما فصل فيه سواء بالرفض أو بالقبول، كما أنه يمكن الطعن فيها بالاستئناف في حالة الأوامر الصادرة عن قاضي الموضوع دون امكانية ذلك أمام قاضي الاستعجال.

The system of suspension of administrative decisions is no less important than other administrative proceedings, as individuals resort to them in order to protect one of their rights guaranteed by law. Accordingly, we examined the system of suspension of administrative decisions in accordance with the Civil and Administrative Procedures Law. This study included the legal nature of the waqf system, as an exceptional measure of the principle, the non-effect of the appeal against cancellation. This study included the formal and objective conditions for stopping the execution of the administrative decision either before the trial judge or before the emergency judge, so that temporary orders are issued by the competent judge, Whether it is dismissed or accepted, and that it can be appealed against in the case of orders issued by the trial judge without the possibility of doing so before the emergency judge.
