Abstract

تعد الصيرفة الإسلامية من أهم المعاملات المتواجدة في الجزائر، والتي تناولها المشرع الجزائري في آخر تقنين وهو نظام بنك الجزائر 20-02 المتعلق بالعمليات المصرفية الإسلامية والذي أنشأ للنوافذ والشبابيك الإسلامية في البنوك التقليدية العاملة في إقليم الجمهورية الجزائرية، والذي حدد لأهم العمليات البنكية الإسلامية شيوعا في العالم الإسلامي، وكيفية الرقابة الشرعية عليها وهيئاتها المعتمدة في إطار التأسيس للشباك أو النافذة البنكية التي تتمتع بالاستقلال المالي والإداري عن باقي هياكل البنك الأخرى، جاء هذا النظام بعد نظام سبقه في 2018 وهو النظام 18-02 المتعلق بالصيرفة التشاركية.
