العنف الز وجي بين أحكام الفقه الإسلامي والقانون الجزائري

Abstract

تهدف هذه الدراسة للبحث في مشكلة العنف ال زوجي لتقف على معرفة أحكامه والآليات الممكنة لمكافحته من منظور الفقه الاسلامي والقانون الجزائري حيث: أن العنف ال زوجي قضية من القضايا المعاصرة القديمة الجديدة خصوصا بعد ظهور نوع جديد من العنف ألا وهو العنف ضد الزوج وهو عنف غير مألوف خاصة في المجتمع العربي، وخصوصا بعد ظهور نتائجه على الفرد والمجتمع وتف ش يها بصورة غير طبيعية. لقد جاءت هذه الدراسة لمحاولة معرفة الأحكام الشرعية الإسلامية وكذا القانونية فيما يخص جريمة العنف ال زوجي وذلك بعد ال ت طرق إلى مفهومه وأنواعه وكذا العوامل الم س ببة له، لنصل في الأخير إلى ال س بل الممكنة للوقاية منه قبل وقو أو علاجه إذا وقع.

This study is baseal on the knowledge of the provisions of marital violence and the possible mechanisms to combat it from the prespective of both the Islamic jurisprudence and the Algérien law in teuns of: Marital violence is new issue of contemporary and old issue,especially after the emergence of new type of violence, namely, violence against the husband, which is unusual violence specialy in the Arabic Society, and specially after the emergence of its consequences on the individual and community and its ab normal prevalence. The stady came to try to know the Islamic legal provision, as well as, the legal in relation to the crime of marital violence, after consiclering its concept and its causes as well as the factors causing it, to give the letter to possible cays to prevent it before it occurs, or treatement after it occurs.
