استغلال براءة الاختراع في التشریع الجزائري

Abstract

يخول لصاحب براءة الاختراع حقا استئثاريا في استغلال اختراعه ومنع غيره من الاستغلال دون موافقته، إذ يمكن أن تكون براءة الاختراع محلا لعدة تصرفات قانونية سواء تم التنازل فيها عن ملكيتها، أو كانت تتعلق بحق الاستغلال والانتفاع بها فقط كالترخيص للغير بالاستغلال. غير أن هذا الحق الاستئثاري ليس مطلقا بل يرد مقيدا حماية للمصلحة العامة، إذ تدخل المشرع وحدد مدة استغلال براءة الاختراع ونطاقها الإقليمي كما فرض نظام الترخيص الإجباري الذي يفسح المجال للغير لاستغلال براءة الاختراع.

Abstract : The owner of the patent has an exclusive right to exploit his invention and prevent others from exploiting it without his consent. The patent can be the subject of several legal actions, whether its ownership has been waived, or it relates to the right of exploitation and use only, such as permitting others to exploit. Nevertheless, this exclusive right is not absolute. It is rather restricted in order to protect the public interest, as the legislator intervened and determined the period of exploitation of the patent and its territorial scope, as well as imposing a system of compulsory licensing, which allows others to exploit the patent.
