آليات مواجهة الفساد في مجال الصفقات العمومية

Abstract

رغم حرص المشرع على إيجاد نظام وقائي يهدف من خلاله للحفاظ على المال العام وترشيد النفقات العمومية ومنع تفشي الفساد وحصر أثاره قبل وقوعه رغم ذالك يقع الفساد وترتكب جرائم الصفقات العمومية لذى تبقى هذه التدابير عاجزة أمام تنوع صور الفساد خاصة في مجال الصفقات العمومية فكان على المشرع ضرورة إيجاد أليات أخرى تخرج من الوقاية الى المكافحة وذلك بتوسيع مجال تدخل القضاء . الكلمات المفتاحية: الفساد- الصفقات العمومية- الرشوة Summary: Despite the legislator’s keenness to find a preventive systemthrough which it aims to preserve public money, rationalize public expenditures, prevent the spread of corruption and limit its effects before it occurs, despite that, corruption occurs and crimes of public deals are committed.
