استغلال العقارات الوقفية الموجهة للاستثمار

Abstract

استحدث المشرع الجزائري عقد استغلال العقارات الوقفية العامة الموجهة للاستثمار بمقتضى المرسوم التنفيذي رقم 18-213 المحدد لشروط وكيفيات استغلال العقارات الوقفية الوجهة لإنجاز مشاريع استثمارية وهذا من أجل ضمان استغلال واستثمار هذه الأملاك الوقفية العقارية المبنية أو غير المبنية وتنميتها والمحافظة عليهـا. حيث تتم عملية استغلال العقارات الوقفية طبقا لما حدده المرسوم التنفيذي رقم 18-213 بموجب عقد إداري بين السلطة المكلفة بالأوقاف والمستثمر عن طريق طلب العروض كقاعدة عامة أو بالتراضي في الحالة الاستثنائية.

SUMMARY :

The Algerian legislator created a contract for the exploitation of public endowment properties destined for investment in accordance with executive Decree no:18-213.Specifying the conditions and modalities for the exploitation of endowment real estate directed to the implementation of investment projects and this is in order to ensure the exploitation and investment of these endowment real estate properties built or not built and there development and preservation where the process of exploiting endowment real estate takes place. In accordance with what is specified in the executive Decree no:18-213 an administrative contract is required between the authority in charge of endowments and the investor by means of offers as a general rule or by mutual consent in the exceptional case.
