سلطة ضبط الصفقات العمومية وتفويضات المرفق العام

Abstract

تعد الصفقات العمومية اآللية اإلستراتيجية التي تعتمد ليها الدولة لتسيير المشاريع االقتصادية عن طريق التمويل العمومي المباشر لها ، األمر الذي أضفى بالمشرع الجزائري إلى إحاطتها بالعديد من األجهزة واآلليات الرقابية سواء الداخلية أو الخارجية ، القبلية والبعدية وحتى الرقابة من نوع خاص والتي تتجسد في سلطة ضبط الصفقات العمومية وتفويضات المرفق العام المستحدثة بنص المادة 213 من المرسوم الرئاسي رقم 247-15 والتي منح لها المشرع من خالله استقاللية التسيير . إن هذه اإلستقاللية ال تعد إستقاللية فعلية وكاملة من الناحية العملية بحكم تبعية هذه السلطة للسلطة التنفيذية األمر الذي يحول دون ممارستها مهامها بنجاعة وهذا ما على المرسوم التنفيذي المنتظر صدوره تداركه حتى تمارس هذه السلطة المهام المنشأة من أجلها. Summary: Public transactions are the strategic mechanism that the state relies on to conduct economic projects through direct public funding for them, which made the Algerian legislator surround them with many control devices and mechanisms, whether internal or external, before and after, and even control of a special kind, which is embodied in the authority to control public transactions. And the mandates of the public service created by the text of Article 213 of Presidential Decree No. 15-247, through which the legislator granted it the independence of management. This independence is not considered actual and complete independence in practice due to the subordination of this authority to the executive authority, which prevents it from exercising its functions efficiently, and this is what the executive decree expected to be issued must rectify it in order for this authority to exercise the tasks established for it.
