دور مجلس الدولة كهيئة استئناف للاحكام القضائية الادارية

Abstract

إن من أهم الوظائف القضائية لمجلس الدولة هي دوره كجهة استئناف فهذا الأخير بممارسته لاختصاصه كقاضي استئناف يعد ضمانة حقيقية للمتقاضين، إذ أنه يعطي فرصة لتصحيح الأحكام الخاطئة الصادرة عن محكمة أول درجة وبذلك يجسد مبدأ التقاضي على درجتين، كما يؤكد على ازدواجية القضاء في الجزائر. ولقد تناول دور مجلس الدولة كجهة استئناف كل من المادة 10 من القانون العضوي 98-01 المتعلق باختصاصات مجلس الدولة وعمله و تنظيمه المعدل و المتمم بالقانون العضوي 11-13، و كذا قانون الاجراءات المدنية و الادارية 08-09 في العديد من مواده بالأخص المادة 902 منه التي أكدت على هذا الدور .

Abstract :

One of the significant judicial functions of the state council is; its role as an appellate instance. It's considered as a genuine safeguard to the litigants by exercising its function. As it offers the opportunity to fix the erroneous judgements made by the first instance court. Thus, enshrining the principle of two degrees of litigation, as well as the double judicial system in Algeria.

The state council as an appellate instance has dealt with each of the article 10 of the organic law 98-01 concerning the terms and organization of the council state as completed by organic law 11-13. As well as, the civil and administrative procedures act in many articles, particularly article 902 which emphasized this function.
