الاستدلال الفقهي بشرع مَن قبلنا في المذهب المالكي – دراسة نماذج مختارة –

Abstract

يتناول هذا العمل موضوع الاستدلال الفقهي بشرع مَن قبلنا في المذهب المالكي، من خلال دراسة تأصيله النظري وتطبيقاته الفقهية التي اخترناها، وذلك بهدف إبراز مكانته في المنهج الاستدلالي في المذهب المالكي وبيان أثره في بناء الأحكام وتوجيه الفروع. وقد انطلقنا في هذا البحث من إشكالية تتمثل في مدى اعتبار شرع مَن قبلنا دليلًا معتبرًا عند المالكية، والضوابط التي تحكم الاحتجاج به، ومجالات حضوره في الفروع الفقهية. واعتمدنا في معالجة هذه الإشكالية على المنهج الاستقرائي في تتبع النصوص والأقوال، والمنهج التحليلي في مناقشة ما جمعناه من المادة العلمية، والمنهج المقارن في عرض الآراء وبيان أوجه الاتفاق والاختلاف. وقد قسمنا البحث إلى فصلين؛ خصصنا الأول للإطار المفاهيمي للاستدلال الفقهي وشرع مَن قبلنا، من حيث التعريف والموقع والحجية، بينما تناولنا في الفصل الثاني التطبيقات الفقهية لهذا الدليل في أبواب العبادات والمعاملات والأقضية والشهادات والحدود والأضاحي. وتوصلنا من خلال هذه الدراسة إلى أن المالكية يعدّون شرع مَن قبلنا دليلًا معتبرًا إذا ثبت بنص شرعنا ولم يرد ما ينسخه، وأن الاحتجاج به عندهم محكوم بضوابط أصولية دقيقة. كما تبين لنا أن لهذا الدليل أثرًا واضحًا في عدد من الفروع الفقهية في مختلف الأبواب التي ذكرناها سابقا، سواء على وجه الاحتجاج المباشر المؤثر بأنواعه أو على سبيل الاستئناس والتأييد. وانتهينا إلى أن منهج المذهب المالكي يتميز بمرونة في توظيف الأدلة التبعية وربطها بالمقاصد والقواعد الكلية، ما أسهم في بناءه منظومة فقهية.

Abstract: This research addresses the subject of jurisprudential inference based on "Shar man qablana" (the law of those who came before us) within the Maliki school of Fiqh. Through a study of its theoretical foundations and selected jurisprudential applications, this work aims to highlight the status of this principle in the Maliki deductive methodology and to demonstrate its impact on constructing rulings (ahkam) and guiding secondary legal branches. The research addresses the problem of the extent to which "Shar man qablana" is considered valid evidence (dalil) for the Malikis, the regulatory principles governing its use as proof, and the areas of its presence in jurisprudential branches. To address this problem, we employed the inductive method to track texts and scholarly opinions, the analytical method to discuss the gathered material, and the comparative method to present various viewpoints and clarify areas of agreement and disagreement. The research is divided into two chapters: the first is dedicated to the conceptual framework of jurisprudential inference and "Shar ‘man qablana "covering its definition, status, and authority (hujjiyya while the second chapter examines the jurisprudential applications of this evidence in the chapters of "Ibadat" (acts of worship), "Mu ‘amalat" (transactions), "Aqdiya" (judiciary) and "Shahadat" (testimony), "Hudud" (legal penalties), and "Adahi" (sacrificial animals). The study concludes that the Malikis consider "Shar man qablana" to be a valid "dalil" if it is proven by a text in our "Shari ‘a" and there is no evidence of its abrogation, provided that its application is governed by precise "Usuli" (jurisprudential) principles. It is also evident that this *dalil* has a clear impact on various across the chapters mentioned, whether through direct, influential argumentation or as a form of support and corroboration. Finally, the research concludes that the Maliki school is distinguished by its flexibility in employing subsidiary evidence and linking it to "Maqasid" (higher objectives) and general principles "qawa ‘id", which has contributed to the construction of its coherent jurisprudential system.
