Abstract

The concept of economic benefits in public procurement applies to the totality of verifiable technical and financial criteria that align with the objectives and constraints of economic efficiency and the rationalization of public expenditure, within the framework of the state's development policy. This unique characteristic of its rules ensures the fulfillment of the principle of public benefit in any public tender, pursuant to the provisions of Article (24) of the Algerian Constitution of 2020. Consequently, Law No. 23-12, dated August 5, 2023, which establishes the general rules governing public procurement, has responded to the requirements of sustainable development goals in general and economic objectives in particular. These include achieving economic efficiency by providing goods, performing services, and executing projects at the lowest cost and with the highest quality. Furthermore, the same law aims to streamline administrative procedures, enhance efficiency, and achieve effectiveness in order to foster a healthy competitive environment, thereby maximizing the utility of the financial resources made available through public demand. In this context, this research study examines the dimensions and applications of the normative criteria upon which the selection of public procurement tenders is based, considering the array of criteria established by the Algerian legislator
