Abstract

لقد حدد المشرع الجزائري المصمحة المتعاقدة في المرسوـ الرئاسي 247-15 المتعمؽ بتنظيـ الصفقات العمومية وتفويضات المرفؽ العاـ باعتبارىا ممثؿ المصمحة العامة فتمثمت في الدولة والجماعات اإلقميمية والمؤسسات العمومية ذات الطابع اإلداري والمؤسسات العمومية الخاضعة لمتشريع الذي يحكـ النشاط التجاري، عندما تكمؼ بإنجاز عممية ممولة كميا أو جزئيا بمساىمة مؤقتة أو نيائية مف الدولة أو الجماعات اإلقميمية. لقد اعترؼ المشرع الجزائري في مركز ممتاز لممصمحة المتعاقدة في مختمؼ قوانيف الصفقات العمومية، وىذا المركز يتمثؿ في: الحقوؽ )السمطات( أو الواجبات) اإللتزامات ( عبر مراحؿ الصفقة العمومية أي أثناء اإلبراـ وأثناء التنفيذ. الكممات المفتاحية: الشفافية، الصفقة العمومية، المصمحة المتعاقدة، المرسوـ 247-15.
