دور الدولة في حماية الرعايا الجزائريين في الخارج

Abstract

تقوم الجزائر كباقي الدول الاخرى ، بحماية مصالحها الخارجية ،ومن بينها حماية رعاياها في الخارج . تعد الحماية الديبلوماسية الوسيلة الاولى الفعالة في هذا الاطار ، وهي نتاج القانون الدولي ، وتكون اجراءاتها عبر مختلف انواع البعثات الديبلوماسية و القنصلية . تعد الاتفاقيات الدولية آلية لحماية الرعايا في الخارج ، وذلك عن طريق تفعيلها سواء عبر نظام الشكاوى للجان الرقابية او اللجوء الى محكمة خاصة بحقوق الانسان . يعد مصادقة الجزائر على اتفاقية المركز الدولي لتسوية منازعات الاستثمار الى حماية رعاياها في الخارج في مجال الاستثمار . الكلمات المفتاحية : الجزائر ، الحماية الديبلوماسية ، الاتفاقيات الدولية ، مبدا المعاملة بالمثل ، سبل الانتصاف المحلية ، حقوق الانسان .

Summary : Algeria, like all other countries, protects its foreign interests, including the protection of its nationals abroad. Diplomatic protection is the first effective instrument in this framework, the product of international law, and its procedures are carried out through various diplomatic and consular missions. International conventions are a mechanism for the protection of nationals abroad, by activating them through the complaints system of the supervisory committees or by resorting to a human rights court. Algeria's ratification of the International Center for Settlement of Investment Disputes (ICSID) to protect its nationals abroad in the field of investment.
