التحكيم في نـزاعات المصارف الإسلامية

Abstract

منذ اعتماد الصيرفة الإسلامية، سواء على مستوى البنوك التقليدية فيما يعرف بالشبابيك الإسلامية أو على مستوى المصارف الإسلامية، أصبحت من بين أهم التحديات التي تواجه هذه المؤسسات-خاصة مع تطور وتعقد وتشابك عقودها-هو تسوية نزاعاتها. استلزم في مقابل هذا الطرح، وجود أطر شرعية خاصة لفض نزاعاتها-بما أنها تقوم على المرجعية الشرعية في معاملاتها ابتداء-سواء كانت نزاعات على المستوى الوطني أو على المستوى الدولي، بعيدا عن الأطر القانونية والقضائية الوضعية التي لا تتماشى وخصوصياتها، فكان التحكيم أبرز الوسائل لتسوية نزاعاتها، لإمكانية تطبيق أحكام الشريعة الإسلامية. فإلى أي مدى يمكن للتحكيم أن يحافظ على خصوصية فض نزاعات المصارف الإسلامية؟ الكلمات المفتاحية: التحكيم-نزاعات-المصارف الإسلامية-المرجعية الشرعية Abstract Since the adoption of Islamic banking, whether through conventional banks in the form of Islamic windows or through fully-fledged Islamic banks, the settlement of disputes has become one of the most significant challenges facing these institutions, particularly with the increasing complexity and interconnection of their contracts. This has necessitated the establishment of special Sharia-compliant frameworks for the settlement of such disputes, given that Islamic banking transactions are fundamentally based on Islamic Sharia principles. These disputes may arise at both the national and international levels, independently from secular legal and judicial frameworks that do not correspond to the specific nature of Islamic banking. Consequently, arbitration has emerged as one of the most prominent mechanisms for dispute settlement due to its ability to ensure the application of Islamic Sharia principles.
