Abstract

This study examined "The Legal System of Mediation in Settling Collective Labor Disputes" under Algerian legislation, particularly Law No. 23-08 and Executive Decree No. 23-363. The study aimed to analyze the conceptual framework of mediation as an alternative mechanism designed to promote social peace and bypass traditional litigation processes. The study concluded that the Algerian legislator established a precise legal system defining the mediator's legal status, obligations, and procedural aspects, emphasizing its consensual nature. Furthermore, the study recommended the necessity of intensifying specialized training for mediators and activating administrative coordination to ensure the effectiveness of this mechanism in stabilizing labor relations.
