لجنة فتح الأظرفة وتقديم العروض في ظل المرسوم الرئاسي 15-247 المتعلق بتنظيم الصفقات العمومية وتفويضات المرفق العام

Abstract

استحدث المرسوم الرئاسي رقم 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، في مجال الرقابة الداخلية لجنة دائمة واحدة أو أكثر تدعى لجنة فتح الأظرفة وتقييم العروض، وأعطى المشرع صلاحية إنشائها واختيار وتعيين أعضائها إلى مسؤول المصلحة المتعاقدة مع اشتراط عنصر الكفاءة والانتماء إلى المصلحة، فتعمل على فتح الأظرفة وتدوين الملاحظات ويمكنها اقتراح عدم جدوى في حالة عدم استلام أي عرض، ثم تحليل وتقييم العروض على مرحلتين لتخلص في نهاية عملها إلى اقتراح إما المنح المؤقت أو عدم جدوى أو إلغاء الإجراء، على المصلحة المتعاقدة تطبيقا للنصوص التي تنظمها في المرسوم سابق الذكر. الكلمات المفتاحية: الصفقات العمومية، لجنة فتح الأظرفة وتقييم العروض، الرقابة الداخلية.

Abstract :

Presidential Decree n° 15-247, about the public procurement regulations and delegation of public services, has created in the field of internal control one or more permanent committees called Opening and Evaluation Committee. The legislator has granted the head of the contracting authority to establish this committee, to choose and appoint its members with the requirement of competency and belonging to this group. The committee opens the tenders, takes note and carries out assessment. The committee can suggest uselessness in the event that no offers are received, then analyze and evaluate the offers in two stages. At the end, the committee can suggest temporary granting, uselessness or canceling the procedure. The contracting authority shall implement the provisions stipulated in the aforementioned decree.
