الرقابة على الصفقات العمومية في ظل المرسوم الرئاسي 15/247

Abstract

تعد الصفقات العمومية الوسيلة المثلى لإستغلال وتسيير الأموال العامة ، وقد جعلها المشرع آداة هامة وفعالة في أيدي السلطة العامة لإنجاز العمليات المالية وتسيير واستغلال المرافق العامة ، وإنجاز المشاريع الحيوية ، وبما أن لها علاقة مباشرة بالأموال العامة وإنجاز المشاريع الكبرى فهي تعد بذلك مجالا معرضا لمختلف أشكال الفساد والتلاعب ، لذلك صار من الضروري إخضاعها لنظام رقابي فعال من خلال وضع آليات محكمة ومتنوعة وهذا ماكرسه المرسوم الرئاسي 15/247 .

Abstract

Public transactions are considered as the best way to exploit and manage public funds. Thus, the legislator has made it an important and effective tool in the hands of the public authority for the completion of financial operations, the management and exploitation of public utilities, and the achievement of vital projects. Since it is directly related to public funds and the implementation of major projects, it is thus considered an area subject to various forms of corruption and manipulation. Therefore, it has became necessary to subject it to an efficient monitoring system by setting up tight and diverse mechanisms, and this is what is enshrined in Presidential Decree 15/247.
