الصكوك السيادية القائمة على إجارة حق الانتفاع في الجزائر - دراسة فقهية قانونية اقتصادية -

Abstract

تهدف هذه الدراسة إلى تحليل الصكوك السيادية القائمة على إجارة حق الانتفاع في الجزائر من منظور فقهي وقانوني واقتصادي، باعتبارها من الأدوات التمويلية الحديثة التي تسعى الدولة إلى توظيفها ضمن توجهها نحو تنويع مصادر التمويل وتطوير آليات التمويل الإسلامي. وقد تناولنا في هذه الدراسة بيان التأصيل الفقهي للصكوك السيادية وإبراز طبيعتها الشرعية من خلال ربطها بعقد إجارة حق الانتفاع وبيان ضوابطه وأحكامه في الفقه الإسلامي، كما تم التطرق إلى الإطار القانوني المنظم لهذه الصكوك في الجزائر وتحليل مدى انسجامه مع خصوصيات هذه الصيغة التمويلية، مع الوقوف على مختلف النصوص القانونية والتنظيمية ذات الصلة. كذلك تناولت الدراسة تحليل الآثار الاقتصادية المتوقعة لاعتماد الصكوك السيادية في تمويل المشاريع العمومية ودورها في دعم التنمية الاقتصادية وتخفيف الضغط على الميزانية العامة، فضلًا عن استعراض أبرز التحديات الشرعية والقانونية والاقتصادية والمؤسساتية التي قد تعيق تفعيلها في الواقع العملي. وقد خلصت الدراسة إلى أن الصكوك السيادية القائمة على إجارة حق الانتفاع تمثل أداة تمويل واعدة تتوافق في أصلها مع أحكام الشريعة الإسلامية وتنسجم بدرجة معتبرة مع البيئة القانونية والاقتصادية الجزائرية، غير أن نجاحها يظل مرهونًا باستكمال التأطير التشريعي والتنظيمي، وتطوير البنية المؤسساتية والسوق المالية، وتعزيز الكفاءات والخبرات المتخصصة بما يسمح بتفعيلها بصورة فعالة تسهم في دعم التنمية الاقتصادية وتحقيق الاستدامة المالية. الكلمات المفتاحية: الصكوك السيادية، الصكوك الإسلامية، صكوك الإجارة، حق الانتفاع، الرقابة الشرعية.

Study Abstract: This study aims to analyze sovereign sukuk based on usufruct ijara in Algeria from a jurisprudential, legal, and economic perspective, considering them among the modern financing instruments that the state seeks to employ within its strategy of diversifying funding sources and developing Islamic finance mechanisms. The study addresses the jurisprudential foundation of sovereign sukuk and highlights their Sharia nature by linking them to the contract of usufruct ijara, clarifying its rules and conditions in Islamic jurisprudence. It also examines the legal framework governing these sukuk in Algeria and analyzes the extent to which it aligns with the specific characteristics of this financing structure, while reviewing the relevant legal and regulatory texts. Furthermore, the study analyzes the expected economic effects of adopting sovereign sukuk in financing public projects, their role in supporting economic development, and their contribution to reducing pressure on the state budget, in addition to reviewing the major Sharia, legal, economic, and institutional challenges that may hinder their practical implementation. The study concludes that sovereign sukuk based on usufruct ijara constitute a promising financing instrument that is fundamentally compatible with the principles of Islamic Sharia and broadly consistent with the Algerian legal and economic environment. However, their successful implementation remains dependent on completing the legislative and regulatory framework, developing institutional structures and the financial market, and strengthening specialized expertise and competencies to ensure their effective activation in a manner that supports economic development and achieves financial sustainability.
