الجباية المحلية كآلية لضمان الاستقلالية المالية للجماعات الإقليمية في الجزائر

Abstract

ركزت هذه الدراسة على الدور الذي تلعبه الجباية المحلية في تعزيز الإستقلالية المالية للجماعات المحلية من خلال محاولة حصر أهم ما يتعلق بالموضوع من جانبه النظري والقانوني، عبر خطوات منهجية لمعالجة إشكالية البحث وتساؤلاته، وذلك انطلاقا من ضبط مفهوم الجباية المحلية هذا فيما يخص الجانب النظري، ثم التعرض للشق القانوني منها والتي تم التطرق فيه لكافة الموارد الجبائية المحلية المخصصة للجماعات المحلية وكيفية تحصيلها والهيئات المكلفة بذلك، ثم تم التعرض لواقع الإستقلالية المالية للجماعة المحلية حيث ركزت على مظاهر الإستقلالية المالية للجماعات المحلية من خلال تبيان اختصاصات وصلاحيات الجماعات المحلية بالإضافة إلى ذكر حدود استقلاليتها. كلمات مفتاحية: الجماعات المحلية؛ الاستقلالية المالية؛ الجباية المحلية Abstract study This studyfocused on the role of the local tax collection instrengthening the financialindependence of local authorities. Theresearch is based on a systematic analysis that highlights all features anddeterminants of our main problematic. In order to deal with suchnexus, we divided the study to two sections. The first one sheds the light on the theoretical and legalframework ofthe aforementioned relation. We tried to present a detailed descriptionto the concepts and approaches, and theories that have been usedpreviously to study the impact ofthe taxation on the local autonomy. The second section is the empirical one that discusses thefollowingelements: the main tax resources, how to collect taxes, the differentinstitution thatare responsible for tax collection and the limits of localautonomy in tax collection.
